Economic analysis of law applied to the teaching of Law: An approach to the use of Game Theory

Resumen El Análisis Económico del Derecho Aplicado a la Enseñanza del Derecho (AED) se erige en las facultades de derecho, particularmente en el área investigativa, como una importante herramienta para el abordaje, transformación y comprensión de las estructuras jurídicas en términos de eficacia económica, constituyendo poco más que una aplicación de los métodos y conceptos propios de la economía, con la finalidad de analizar las instituciones jurídicas, es decir, desde los efectos de la norma en la sociedad, más que de la creación o su relación con la justicia. Dentro de las herramientas que ha tomado prestadas el derecho de la economía se encuentra la teoría de juegos, cuyo mayor atractivo reside en la posibilidad de ser aplicada al comportamiento de los individuos que interactúan en una sociedad con fines prescriptivos, en concordancia con lo cual el presente texto evidencia la utilidad de esta herramienta al interior de los procesos educativos del derecho, como mecanismo para mejorar la comprensión de las instituciones jurídicas, su funcionalidad y su importancia a nivel social.

Abstract The Economic Analysis of Law Applied to the Teaching of Law (AED) has raised itself in the faculties of law particularly in the investigative field, as an important tool for the boarding transformation and comprehension of the juridical structures from the efficiency in economic terms, it constitutes little more than an application of the methods and concepts of the economy science with the purpose of analyzing the juridical institutions from the efficiency, it is to say from the effects of the norm in the society, more than from the process of creation or his relation with the justice. A tool used from the economy is the game theory, whose mayor attractive would reside in the possibility of being applied to the analysis of the behavior of the individuals who interact in a society with prescriptive purposes; in conformity with which the present work chases to demonstrate the utility of this tool to the interior of the educational processes of the right, with a view to improving the comprehension of the juridical institutions, his functionality and his importance.

State’s legal responsibility and legislative function On the responsibility of the State for the improper processing of legislative initiatives of a popular nature

Resumen Este artículo analiza la procedencia de imputar responsabilidad patrimonial al Estado, bajo el título de imputación de la falla en el servicio, cuando el Congreso de la República en ejercicio de su función, vulnera normas, reglas o principios constitucionales y legales que rigen el procedimiento legislativo cuando este ha tenido origen en una iniciativa popular. Se realizó revisión bibliográfica y jurisprudencial del estado del arte y se tomaron casos como referencia de análisis, estableciendo, que puede predicarse la responsabilidad del estado legislador, por falla en la función legislativa ocurrida dentro del trámite de una iniciativa de origen popular. Si bien, falta desarrollar a profundidad la tipología de responsabilidad propuesta, el artículo encuentra argumentos suficientes para señalar la existencia de un tipo de responsabilidad del Estado legislador hasta ahora no analizado.

Abstract This article analyzes if it is appropriate to attribute patrimonial responsibility to the estate, under the imputation title of the service failure, when the Parliament in exercise of its duties breaks the constitutional norms, rules or principles that regulate the procedure to rule a legislative initiative of a popular nature. A bibliographic and jurisprudential review of the state of the art was made and cases were taken as a reference for analysis, establishing that the responsibility of the legislating estate can be predicated, due to a failure in the legislative function that occurred within the process of an initiative of popular origin. Although the proposed typology of responsibility must be developed in depth, the article finds sufficient arguments to indicate the existence of a type of responsibility of the legislating State that has not yet been analyzed.

The private military and security companies: The beginning of the end for States?

Resumen El propósito del presente artículo es el de problematizar las principales repercusiones que tiene la proliferación de las Compañías Militares y de Seguridad Privada (CMSP) como resultado del orden económico neoliberal en los ámbitos externos e internos de la soberanía de los Estados. Para este cometido, se realizó una revisión documental de fuentes empíricas y teóricas que den cuenta de esta problemática. Se llegó a la conclusión de que este fenómeno exhibe una contradicción de la filosofía económica liberal por tanto, inscribe la seguridad como un servicio público ordinario. También, que los contextos más susceptibles de dicha privatización son aquellos donde impera la debilidad institucional y humanitaria.

Abstract The aim of this paper is to problematize the main effects of the Private Military and Security Companies proliferation as a result of a neoliberal economic order in the external and internal spheres of States sovereignty. In this regard, a documental review with empirical and theoretical sources was used in order to understand this problematic. The first conclusion is that there exist a lack in the liberal economic philosophy concerning the treatment of security as a public service. Second, it was found that the effects of security privatization are more evident in countries where humanitarian and institutional weakness persists.

Consumer protection system in the framework of a dynamic model of governance

Resumen El derecho de los consumidores desarrolla principios constitucionales que permiten integrar un modelo de cogobierno estructurado a partir de agentes que cooperan para el funcionamiento del sistema de protección a los consumidores en Colombia. El rol desempeñado por cada uno de los agentes determina la mayor o menor protección en las relaciones de consumo. El análisis cualitativo de los diferentes niveles de funcionamiento del sistema relacionados con las interacciones sociopolíticas entre la autoridad pública de control, la sociedad civil organizada, los proveedores de bienes y servicios en las relaciones de mercado y la existencia de una autoridad sancionatoria, determina la mayor o menor protección de los derechos de los consumidores. Las fisuras en la protección derivan de una interacción blanda en los niveles operativos de cogobierno, que inciden negativamente en el desarrollo de las relaciones de consumo.

Abstract The right of consumers develops constitutional principles that allow the integration of a structured co-government model based on agents that cooperate for the functioning of the consumer protection system in Colombia. The role played by each of the agents determines the greater or lesser protection in consumer relations. The qualitative analysis of the different levels of functioning of the system related to the sociopolitical interactions between the public control authorities, organized civil society, suppliers of goods and services in market relations and the existence of a sanctioning authority, determines the greater or less protection of consumer rights. The fissures in protection derive from a soft interaction in the operating levels of co-government, which negatively affect the development of consumer relations.

Sociopolitical implications regarding the service of potable water in a demarcation of the city of Mexico

Abstract Social representations are visions of the everyday world that historically are constructed together with the diffusion of the media that intensify their audiences. The printed media availability and water policy has not only been reduced to opinions by the press, but also two logics have been grown on the credibility of the information and the truthfulness of it. This study exposes the lines of discussion for the analysis of tandem policies and agenda setting in the availability and supply of water. The results show frames from newspaper audiences are considered promoters of a relative deprivation that is the conformism of the service quality of public water supplies.

Resumen Las representaciones sociales son visiones del mundo cotidiano que históricamente se construyen junto con la difusión de los medios que intensifican sus audiencias. La disponibilidad de medios impresos y la política del agua no solo se han reducido a las opiniones de la prensa, sino que también se han desarrollado dos lógicas sobre la credibilidad de la información y la veracidad de la misma. Este estudio expone las líneas de discusión para el análisis de políticas en tándem y el establecimiento de agenda en la disponibilidad y el suministro de agua. Los resultados muestran que los marcos de las audiencias de los periódicos se consideran promotores de una privación relativa que es el conformismo de la calidad del servicio público del agua.

Referents on educational inclusion for people with disabilities: lines to think about their potential in the school setting

Resumen Se plantea la inclusión como un proceso de amplias discusiones tanto en el ámbito internacional como nacional que paulatinamente va conquistando espacios para garantizar el derecho a la educación de todas las personas. En primer término, se exploran los antecedentes normativos que permiten entender el devenir de la atención educativa a las personas con discapacidad, luego, se realiza un rastreo por Argentina, Brasil, Chile, Colombia, Ecuador, países que han adoptado la Convención de los Derechos de las personas con discapacidad, con la intención de observar los avances frente a las modalidades de atención educativa. A la vez, se rastrean investigaciones sobre experiencias de inclusión educativa tanto en Colombia como en países iberoamericanos con el ánimo de visualizar tendencias y establecer referentes para comprender este hecho y poder entender su potencial en el día a día del ámbito escolar permitiendo la emergencia de nuevos saberes con relación al proceso mismo.

Abstract The inclusion is proposed as a process of broad discussions at national as well as the international level that gradually gaining spaces to guarantee the education rights for all the people. First, it explores the normative that allows to understand the educative attention focused on people with disability. In order to identify the progress in the educative attention modalities, we search about the rights for the people with disability in countries like Argentina, Brazil, Chile, Colombia, and Ecuador, which have signed the Convention of the Rights of Persons with Disabilities. At the same time, we analyze other researches about experiences in educative inclusion in Colombia and in other Iberic-American countries to visualize tendencies and establish references to understand this fact and be able to understand the potential in the school environments allowing the emergence of a new field of knowledge in relation with the same process.

The quality of democracy. Examination of its conceptual basis at the beginning of the 21st century

Resumen Actualmente uno de los campos de mayor relevancia en el estudio de la democracia es el de su calidad. Por lo tanto, se formularon unos supuestos conceptuales para definirla que sirven como punto de partida y diálogo entre diversos autores. Adicionalmente, se realizó una revisión de literatura acerca del desarrollo y evolución del concepto. El rastreo se realizó con el propósito de indagar acerca de la “calidad de la democracia” y cuáles factores e indicadores se han utilizado para medir su utilidad. Los hallazgos evidenciaron que los estudios sobre la democracia parten de una definición operativa fundamentada en el concepto de poliarquía, que le ha permitido delimitar su objeto de estudio y centrarse en aspectos institucionales bajo postulados conceptuales a partir de por lo menos tres diferentes enfoques de análisis.

Abstract Currently one of the most relevant fields in the study of democracy is its quality. Therefore, conceptual assumptions were formulated to define it as a starting point and dialogue between various authors. Additionally, a literature review was made about the development and evolution of this concept. The tracking was conducted to investigate about "quality of democracy" and which factors and indicators have been used to measure its usefulness. The findings showed that the studies on democracy start from an operative definition based on the concept of polyarchy, which has allowed it to delimit its object of study and focus on institutional aspects under conceptual postulates from at least three different analysis approaches.

Corporate Social Responsibility (CSR): revisiting concepts and approaches

Resumen El propósito de este artículo es identificar conceptos y enfoques clave de la investigación académica en el estudio de la Responsabilidad Social Corporativa (RSC). Se utilizó una técnica bibliométrica basada en la teoría de grafos para la orientación de la búsqueda y la selección de los artículos. Esta técnica reconoce las conexiones entre artículos ISI que fueron publicados sobre RSC en el periodo 2001 a 2016. Estas conexiones remiten a los autores seminales que permiten rastrear la evolución del concepto y definir los enfoques que se han manifestado en la literatura académica del management. Los principales resultados son cinco enfoques teóricos con los cuales se aborda el análisis y comprensión de la RSC: institucionalidad, reputación y desempeño, talento humano, estrategia y finanzas. Este estudio propone un método alternativo para investigar la evolución conceptual de la RSC, que sirve de antecedente a futuras investigaciones en este campo académico.

Abstract The purpose of this paper is to identify key concepts and approaches in Corporate Social Responsibility (CSR) academic research. A bibliometric technique based on graph theory was used to guide the paper searching and collection. This technique recognizes connections among ISI papers that were published in the CSR field from 2001 to 2016. These connections refer to seminal authors who have tracked the CSR evolution and defined its theoretical approaches in management academic literature. The main results are five theoretical approaches in CSR analysis and understanding: Institutionalism, Reputation and Performance, Human Talent, Strategy and Finance. This study proposes an alternative method to investigate the CSR conceptual evolution, which may be used as a precedent for future research in this academic field.

Social representations of the “argentine identity” in the native population resident in the Autonomous Cityof Buenos Aires

Resumen El artículo analiza las representaciones sociales que construyen los residentes de la Ciudad Autónoma de Buenos Aires acerca de los atributos y características culturales que definirían la identidad argentina. Se analizan parte de los resultados de una encuesta realizada en el 2014 donde se caracterizarían atributos principales de los argentinos. Se pretende reflexionar acerca de los procesos de esencialización, calificación, clasificación y jerarquización de situaciones y personas, que todo proceso de construcción de la notridad supone. Entre los principales hallazgos se encuentran que los encuestados se identifican con la categoría denominada representación iconográfica y con la de soberbia/arrogancia. En cuanto a las representaciones positivas, se registraron en las categorías adaptabilidad/tenacidad, seguido de solidaridad., y finalmente, en relación a los atributos negativos, la soberbia/arrogancia, es considerada como la principal característica.

Abstract The article analyzes the social representations that residents of the Autonomous City of Buenos Aires build about the attributes and cultural characteristics of Argentine identity. To analyze this Argentineans attributes, it was used part of the results of a survey conducted in 2014. It refers to the processes of essentialization, qualification, classification and ranking of situations and people, supposed in any building notoriety process. Among the main findings are the identification of respondents with the category called iconographic representation and with pride/arrogance. On the positive representations side, they were registered in the categories of adaptability/tenacity, followed by solidarity. Finally, in relation to the negative attributes, arrogance is considered as the main characteristic.

Neurolearning, an educational proposal: tools to improve teacher praxis

Resumen Este estudio tiene como objetivo proponer estrategias pedagógicas innovadoras para los procesos de enseñanza-aprendizaje de los programas de la Facultad de Educación de la Corporación Universitaria Adventista, donde se apliquen procesos desde la base del neuroaprendizaje y la neuroeducación y es derivado de una investigación con enfoque cualitativo y de tipo documental. Para la búsqueda, revisión y análisis de la literatura se aplicó una matriz, teniendo en cuenta el protocolo que normatiza la investigación. Como resultado del estudio se observa que hoy en el aula, desde la mirada de la neuroeducación, la educación demanda una formación docente que genere cambios acelerados para ejercer la enseñanza y vincule los aportes neurocientíficos con la práctica pedagógica. La investigación permite concluir que la nueva tendencia rompe el modelo del profesor tradicional, constituyéndolo en un neuroeducador y al aplicar las estrategias de la neurociencia a la neuroeducación, se favorece la enseñanza y se pueden obtener mejores resultados en el momento de la adquisición, retención y aplicación del aprendizaje en el educando.

Abstract The aim of this study is to propose innovative pedagogical strategies for the teaching-learning processes with a Neurolearning and Neuroeducation base for the programs in the Education Faculty in the Corporation Colombian University Adventist. This article has a qualitative and documentary approach. For the search, review and analysis of the literature, we applied a matrix with a protocol to regulate the research. As a result of the study, we observed from the neuroeducation perspective that currently in classroom, education demands a qualify teacher training to accelerate changes in teaching practice and to link acording to neuroscientific contributions with pedagogical approach. This investigation concludes that this new tendency breaks with the traditional model of the professor, and constitutes him/her as a neuroeducator. Applying the Neuroscience strategies to Neuroeducation favors teaching and it can obtained better results in the acquisition, retention and application of student learning process.

School ethnography of the cellphone as a resource for building scape spaces

Resumen Este artículo socializa los resultados de una investigación etnográfica que abordó el uso del teléfono celular como un foco para analizar las dinámicas de socialización de los adolescentes en un colegio privado de la ciudad de Bogotá. Para ello se tuvieron en cuenta las interacciones dentro y fuera del aula de clases, abarcando tanto espacios regulados como informales. El análisis de dichos escenarios evidenció que el uso del móvil tiene un alto atractivo social para los adolescentes, dándole cabida aún en espacios donde está prohibido e inscribiendo su uso en lo que se denominó espacios de fuga.

Abstract This paper socializes the results of an ethnographic research that approach the cellphone use as a lens to analyze the teenager’s socialization dynamics in a private School of Bogotá. To this end, interactions within and outside the classroom were considered, encompassing both regulated and informal spaces. The analysis of these scenarios showed that the use of the mobile phone has a high social attractiveness for adolescents, giving to it a place even in spaces where it is prohibited and inscribing its use in what is called here escape spaces.

Sociojuridical memories of Medellin and Antioquia. An analysis of the “black” story as evidence of the real source of the Law

Resumen El presente artículo muestra una aproximación sociojurídica a los contextos históricos de la producción literaria colombiana, especialmente, los escenarios que se han tomado en los últimos 30 años como telón de la novela “negra” o de crímenes en Medellín y Antioquia. Esto con el fin de ejemplificar, a partir de cuatro obras clave de la narrativa antioqueña, las características sociales e históricas que se constituyeron en su momento como fuentes reales o materiales del derecho en Colombia. Con una investigación cualitativa basada en un estudio documental con análisis de textos, pudo obtenerse un registro de más detallado de cómo las situaciones particulares son el punto de partida de las leyes y disertaciones jurídicas que tienen vigencia hoy.

Abstract This article shows a social-legal approach to the historical contexts of Colombian literary production, especially, the scenes that have been taken over the past 30 years as a curtain on the "noir" or crime novel in Medellin and Antioquia. This, in order to exemplify from four key works of the Antioquia narrative, the social and historical characteristics that were constituted at the time as real or material sources of Law in Colombia. This can be attained by conducting a qualitative research based on a documentary study with text analysis, a more detailed record of how particular situations are the starting point of the Law and legal dissertations that are valid today.

Analysis of the difficulties of English-speaking students with learning Spanish in Jamaica

Resumen El presente artículo surge de un trabajo investigativo cuyo objetivo fue describir cuáles son las mayores dificultades que enfrentan los estudiantes angloparlantes jamaicanos en el aprendizaje del español e identificar y analizar qué tipo de errores son más comunes entre estudiantes orientados con docentes nativos y estudiantes con profesores no nativos, así mismo, identificar los errores que tienden a fosilizarse con más facilidad entre estos aprendices angloparlantes jamaicanos. Se puede concluir que los errores cometidos por estudiantes orientados por docentes nativos y no nativos señalan la presencia indiscriminada de errores fosilizados, dada la fuerza de la interferencia de la L1, el inglés, común a ambos grupos de estudiantes.

Abstract The present article arises from a research work whose main objective was to describe, through the analysis of errors, the main difficulties faced by English-speaking Jamaican students in learning Spanish, identifying and analyze what type of errors are most common among students of a native teacher of Spanish and those of non-native teacher, as well as identifying the errors that tendency is to fossilize in an easier way among these Jamaican English-speaking learners. The mistakes made by the students in both teachers, indicate the indiscriminate presence of fossilized errors, given the strength of the interference of the L1, English, common to both groups of students.

Contributions of psychoanalytic theory for the understanding of addictions

Resumen El presente artículo contribuye a la comprensión de la problemática de las adicciones a partir de los planteamientos teóricos del psicoanálisis. Para ello, se revisaron las posiciones del psicoanálisis freudiano, lacaniano y otras corrientes psicoanalíticas respondiendo a las siguientes preguntas de investigación: ¿Cómo se comprenden las adicciones desde un marco de referencia psicoanalítico?, ¿Cómo desde la teoría freudiana y la teoría lacaniana se aborda la comprensión de la adicción?, ¿Qué plantean otras corrientes del psicoanálisis sobre ésta problemática? Se encontró que es un campo de constante publicación de literatura psicoanalítica, que es un fenómeno clínico en aumento y que se requiere de investigación continua.

Abstract The following article contributes to the understanding of the problem of addictions from a psychoanalytic point of view. The different theoretical positions of Freudian, Lacanian and other psychoanalytic schools were reviewed in order to answer the following research questions: How are addictions understood from a psychoanalytic point of view? How - from Lacanian and Freudian theory - is the understanding of addiction addressed? What do other schools of psychoanalysis state about this problem? It is found that it is a field of constant publication in the psychoanalytic literature that it is an increasing clinical phenomenon and that continuous investigation is required in this field.

Medicine in Michel Foucault: Meta-synthesis

Resumen La salud pública ha sido influenciada por Michel Foucault; sin embargo, el análisis de sus obras sobre medicina ha sido marginal. El objetivo de esta investigación fue caracterizar las publicaciones científicas relacionadas con medicina en la obra del filósofo francés, siguiendo las fases de identificación, tamización e inclusión de la guía PRISMA. La incidencia de este autor en la antropología y sociología médica es evidente. Sin embargo, hay un vacío considerable en temas referidos a la ética médica. Estos hallazgos constituyen un insumo valioso para mejorar las investigaciones sobre la ontología del presente, desde metodologías foucaultianas, en áreas poco exploradas como la medicina basada en la evidencia, la molecularización del diagnóstico clínico, el creciente interés por el discurso de las neurociencias y la autogestión del bienestar en las sociedades actuales.

Abstract Michel Foucault has had an impact on public healths; however, analysis of his works about medicine have been marginal. The objective of this research was to characterize the scientific publications related with medicine in the work of the French philosopher, following the phases of identification, screening, eligibility and inclusion of PRISMA guide. The incidence of Foucault in medical anthropology and medical sociology is clear. However, one of the topics with less research is Foucault's contribution to the field of medical ethics. These findings constitute a valuable input to improve research on the ontology of the present, from Foucaultian methodologies, in areas little explored such as evidence-based medicine, the molecularization of clinical diagnosis, the growing interest in neuroscience discourse and self-management of welfare, driven by the dynamics of "advanced liberal" government.

Exile and return migration. A comparative reflection for the Colombian case

Resumen El artículo tiene como objetivo examinar el fenómeno de migración de retorno de exiliados colombianos, a partir de una lectura comparativa con lo sucedido en el Cono Sur durante las dictaduras militares. En este sentido, se establece un diálogo entre distintos relatos literarios de exiliados del Cono Sur que muestran la complejidad existencial del proceso de retorno y en algunos casos, la imposibilidad de regresar. Dicho diálogo aportará elementos de análisis que permitirán la comprensión del exilio como una ruptura y la migración de retorno como una posibilidad que se abre en el posconflicto.

Abstract This paper aims at exploring return migration’s phenomenon of Colombian exiles from a comparative lecture of what happened in the Southern Cone of Latin America during the military dictatorships. In this respect, a dialogue is established between different literary stories of exiles from the Southern Cone that show the existential complexity of the return process and, in some cases, the impossibility of returning. This dialogue will provide elements of analysis that will allow the understanding of exile as a rupture and return migration as a possibility that opens up in the post-conflict.
