^les^aEste artículo analiza la nueva problemática ocasionada por el crecimiento de desarrollos urbanísticos privados en América - particularmente enfocado a la Argentina - y propone como tesis que el derecho privado que actualmente normativiza la cuestión, es insuficiente para dar respuesta a la complejidad de las nuevas relaciones jurídicas que se entablan, particularmente entre vecinos y emprendedores. Sostiene y fundamenta sobre la base del análisis de derecho comparado, casos y diversos fallos judiciales, que esa regulación debe provenir esencialmente del derecho público, dando así preponderancia al derecho administrativo, municipal y urbanístico en la regulación del tema.^len^aThe present article discusses the new issues caused by the growth of private urban developments in America - particularly focused in Argentina - and proposes as a thesis: how the present regulation is insufficient to meet the complexity of the new legal relationships, particularly among the neighbors and entrepeneurs. The text builds its bases on the analysis of comparative law and various court cases, which manifest that such regulation should come primarily from public law, which would give superiority to the administrative, municipal and city-planning in the regulation of the subject.
