^les^aEl presente texto da cuenta de una de las principales problemáticas del constitucionalismo colombiano: la persistencia de la inestabilidad constitucional, y de cómo ella, que se inscribe en una tradición muy propia de los sistemas jurídicos de América Latina, está lejos de resultar armónica con los postulados básicos del movimiento constitucional, así como con las trayectorias institucionales de sociedades que presentan mejores indicadores de desenvolvimiento económico y democrático. En el escrito se advierte de la íntima conexión entre esta realidad y las inconsistencias técnicas de la Constitución de 1991, que no previó los mecanismos adecuados para la salvaguarda del pacto constituyente. Por esta vía, quedó abierta la puerta para que sea el juez constitucional el que, a través de la teoría de la sustitución de la Constitución, le establezca límites al poder de reforma.^len^aThis article describes one of the main problems of constitutionalism in Colombia: the persistence of constitutional instability, and the way in which this instability, representing a very common tradition in Latin American legal systems, is far from harmonizing with the basic tenets of constitutionalism, as with the institutional developments of societies showing better indicators of economic and democratic performance. This paper underscores the intimate connection existing between this fact and the technical inconsistencies of the 1991 Colombian Constitution, which did not create the adequate mechanisms needed to protect the country's constitutional pact. In this way, an opportunity was created for those judges deciding constitutional issues to establish limits on the power of constitutional reform, through the theory of the substitution of the Constitution.
