^les^aEste artículo es un producto del proyecto de investigación "El municipio colombiano y sus posibilidades de desarrollo económico y social", que es una tesis doctoral que se está adelantando, dentro de la línea de ordenamiento territorial del grupo de investigación "Estudios de Derecho Público" teniendo como contexto el ámbito nacional y terminando en el tema de las remesas para el fortalecimiento municipal. El Estado colombiano reconoce los derechos inalienables de las personas y ampara la familia como institución básica de la sociedad, de manera que resulta pertinente hacer un análisis de los mecanismos que consagra el ordenamiento jurídico para garantizar los derechos de las personas que libremente deciden salir del territorio nacional, así como de quienes ingresan a él, de manera transitoria o permanente. En este trabajo se presenta de manera general el cambio de paradigma que se ha dado en torno al tema migratorio, pues si bien siempre se han presentado movimientos de personas entre las fronteras, el tema adquiere relevancia en el contexto de la globalización. En la primera parte se expone cómo en nuestro ámbito nacional todavía existe un amplio camino por recorrer con respecto a la armonización y la integración de acciones para hacer frente al tema migratorio y en la segunda parte se hace una revisión sobre el tema de remesas que es el que más interés ha generado en los estudios sobre migraciones, y precisamente se hace como un tema subsidiario, porque se considera que primero debe atenderse a la protección de la persona y en segundo lugar se deben aprovechar las oportunidades que el tema migratorio por las remesas y sus efectos económicos genera para promover el fortalecimiento del municipio.^len^aThis article is the result of a doctoral dissertation thesis research project entitled "El municipio colombiano y sus posibilidades de desarrollo económico y social" (The Colombian municipality and its possibilities of economic and social development) carried out within the Public Law Studies Group, which takes into account the national context and which concludes that remittances end up strengthening municipalities. The State of Colombia recognizes inalienable rights of people and protects family as a pivotal society institution; therefore the analysis of mechanisms set out in the legal rules to guarantee the rights of people that decide to freely leave the national territory as well as of those entering either transitorily or permanently is made. The change of paradigm related to migrations is presented to the extent that though people movement between borders has always been evidenced, the issue gets to be more important in the context of globalization. In the first part of the article a presentation on the steps to be taken as to harmonization and integration of actions versus migrations is made, and in the second part, a revision on remittances, a topic of great interest and focus in studies on migrations is presented; this later approach is made in a subsidiary fashion because it is considered that the focus has to exist first on the protection of persons, and later on taking advantage of the opportunities generated by remittances regarding migrations and their contribution to the strengthening of municipalities.
