^les^aEl artículo explora la incidencia de las cuestiones medioambientales sobre el modo en que debe entenderse el concepto de estado de necesidad en derecho internacional. Dicha incidencia es analizada a partir de dos perspectivas diferentes, a saber: la del Estado que invoca una "necesidad ecológica" para justificar la violación de una obligación internacional y aquélla del Estado cuyos intereses medioambientales han sido menoscabados por los actos que el otro Estado intenta justificar a partir del estado de necesidad. El análisis efectuado sugiere que el modo en que se deben interpretar los requisitos necesarios a la admisión de un estado de necesidad depende del tipo de interés, en este caso medioambiental, que el Estado en dificultad intenta preservar.^len^aThe article explores the incidence of environmental considerations on the understanding of the concept of state of necessity in international law. This incidence is analyzed from two perspectives, namely that of a State invoking an "ecological necessity" to justify its acts in breach of an international obligation and that of a State whose environmental interests have been impaired by the acts that the other State seeks to justify through necessity. The analysis suggests that the interpretation of the conditions for the admission of the necessity defense depends upon the type of interest, in this case environmental considerations, that the State invoking necessity seeks to preserve.
