^les^aEl artículo presenta la experiencia de Estados Unidos en el desarrollo e imple-mentación de mecanismos jurídicos y extrajurídicos encaminados a proteger a los concesionarios ante la incorporación de cláusulas abusivas en el contrato de concesión privada. En ese sentido, a partir del estudio de la legislación, la jurisprudencia y las iniciativas del sector privado, se identifican medidas legislativas, administrativas y privadas encaminadas a la consecución de este objetivo. Igualmente, el estudio del caso estadounidense refleja cómo la aplicación de la doctrina de cláusulas abusivas es posible en contratos diferentes a aquellos catalogados como de consumo.^len^aThe article presents the United States' experience in the development and implementation of legal and extralegal mechanisms aimed at protecting franchisees before the incorporation of unconscionable clauses in a franchising agreement. From the analysis of the statutes, case law and private sector initiative, it is possible to identify legislative, administrative and private measures aimed at achieving this objective. Likewise, the study of the American case shows how the implementation of the unconscionability doctrine is possible in contracts different from those considered as consumer contracts.
