The responsibility for the contractual activity related to the non-adjudication or the unduly adjudication of a contract has deserved different postures from jurisprudence and doctrine. In the jurisprudence of the State Council, three different and even regressive postures have been identified since 1988. they refer to the percentage of utility that should be paid as indemnity which is based on the illegal exclusion of a bidder from a contractual process or in the adjudication of a contract by someone who has not bidden the best proposal. This article aims at approaching these jurisprudential changes.
