El reciente hundimiento por parte del Congreso de la República de Colombia del segundo intento de reglamentación del derecho a morir dignamente concita la obligación de reflexionar sobre un tema profundamente complejo porque desborda la esfera de la discusión, del terreno social o netamente jurídico hacia la órbita de la ética; por ende, de la filosofía, atendiendo a ello este escrito planteará la reflexión considerando el carácter confesional del que se han impregnado, trascendentales decisiones del legislador, así como obstaculizado principios constitucionales como el de la pluralidad, el de la dignidad humana y el de autonomía, fundamentales en un Estado que, por vocación popular, se declaró Social y Democrático de Derecho.

Los protagonistas de este escrito serán, por un lado, el legislador en su función de asignador de nombres, por el otro la Iglesia Católica como institución capaz de ligar la iniciativa de los fieles.

The recent collapse by the Congress of the Republic of Colombia of the second attempt to regulate the right to die with dignity raises the obligation to reflect on a deeply complex issue because it goes beyond the sphere of discussion, from the social or purely legal terrain towards the orbit of ethics; Therefore, of philosophy, in response to this, this writing will raise the reflection considering the confessional nature of which, transcendental decisions of the legislator have been impregnated, as well as hindering constitutional principles such as plurality, human dignity and autonomy, fundamental in a State that, by popular vocation, declared itself Social and Democratic in Law.

The protagonists of this writing will be, on the one hand, the legislator in his role as assignor of names, on the other the Catholic Church as an institution capable of linking the initiative of the faithful.
