Today homebuyers are unprotected from certain vices that emerge imperceptibly in their properties, but over time progress progressively to generate structural failures that end up deteriorating or collapsing their buildings. These defects are not covered by civil protection mechanisms such as redhibitorial action and ten-year guarantee. This article explores the possibility of going to the real estate guarantee established by the Consumer Statute as a way for people to obtain the protection of their rights and hold sellers accountable for such defects.
