Abstract

Taking into account the dispositions of Section 115 of the Criminal Code of Colombia as a starting point, this paper presents a discussion of some theoretical aspects, classification and diagnostic criteria of ‘Psychic Perturbation’ based on the fact that such perturbation consists of damage to mental or psychic health as a consequence of a punishable conduct. The notion of damage is analyzed, as well as the concept of reaction, injury and clinical substrate in order to establish, from a forensic perspective, that Psychic Perturbation is a significant clinical disorder, affecting the subject’s global psychic activity. The symptoms clearly identify an internationally accepted syndrome, which include maladaptive behavior that remains for a certain period of time. Its etiology is well-defined to the extent that it allows a causality relation to be established as a result of a deviant conduct typified by the competent authority.
