The legal discussion on minority rights is booming. Both domestic and international law systems face the challenges of an increasingly diverse world, in which the distinction between majorities and minorities tends to become inconsequential. Within this context, the matter of LGBTI community rights gains relevance. International law has set standards for a broad and evolutionary interpretation of these rights, rooted in new sexual orientation and gender identity concepts, in terms of equality, and as a consequence of their rights to marry and found a family. Analyzing these rights requires the use of formal sources and soft law as well as comparative law.
