Abstract

RENZA, Boris Carvajal  and  POLANCO, Franklin Díaz. The Rome Statute and International Crimes. Reflections on its Applicability with Respect to Colombia. Prolegómenos [online]. 2022, vol.25, n.49, pp.11-25.  Epub June 30, 2022. ISSN 0121-182X.  https://doi.org/10.18359/prole.5560.

August 5, 2022 marks two decades since Colombia ratified the Rome Statute of the International Criminal Court. Therefore, a review of the most relevant aspects arising from this treaty is proposed. Consequently, this article identifies the scope and limits of the International Criminal Court to investigate and Judge Colombian citizens, the current situation and the panorama that is envisioned in the country, considering the serious crimes that have been committed in the national territory during the internal conflict and on the sidelines from it. It will highlight the challenge for the Colombian State to show tangible results in terms of criminal investigations and the effects, if it does not inter vene satisfactorily with its judicial apparatus, in accordance with the mandates of the Rome Statute.

Keywords : Rome Statute; International Criminal Court; international crimes; Colombia.
