Abstract

ARDILA TRUJILLO, Mariana. Toward the Conflict's Resolution between the Protection of the Cultural Diversity and the Recognition of the Women's Rights. Rev. Derecho Estado [online]. 2011, n.26, pp.107-135. ISSN 0122-9893.

The text tries to set some starting points to solve the conflicts between women's rights and respect for cultural diversity. A tension between these two sides appears when a claim for sexual equality collides with a distinctive characteristic from a Nation, an ethnic group or a religion, according to which men and women should not receive the same treatment. Even international law is in favor of women's rights in this type of conflicts, a unique answer must be rejected because that would ignore the value of respect for cultural diversity, except in cases of violence against women in which always we must support its elimination. To begin to solve these conflicts, we must situate them geographically and historically and we must consider the opinion of the woman from that ethnic group, Nation or religion, always considering that cultures change and are use, many times, to maintain power.

Keywords : women's rights; sexual equality; cultural diversity; religious diversity.
