This article analyses the legal basis and the operation of a National Program established in order to guarantee health care of children, titled "xxist Century Health Insurance". The objective is to make a public policy proposal to improve the position of the Health Insurance Program in Mexico's legal system. At the present time, this Program depends on budgetary rules with an annual validity. This situation contradicts the significance of its target, which is precisely the health care of children in their early stages of life and the effectiveness of the fundamental right to health. In that sense, this paper establishes the basis to consolidate this Program through a legal reform and its integration in the Mexican System of Social Protection in Health.
