Abstract

In this article, a qualitative study was carried out in which a documentary review investigation of articles, books, laws and jurisprudence was carried out, through the use of documentary files, to obtain a correct analysis of them. The main objective was the study on the so-called solution of continuity in the contract for the provision of services and to make visible the problem of the reality of the Contract for the Provision of Services in the Public Administration in Colombia. What was done with the analysis and specific development of the following three fundamental concepts: 1. The background, principles and normative regulation of public contracting, 2. Review of the jurisprudential positions that the Constitutional Court and the Council of State have made on contracts for the provision of services and the configuration of the reality contract, and 3. The solution of continuity its relationship with the actual contract in contracts for the provision of services with state entities. In sum, it was concluded that in most of the cases in which an employment relationship is alleged before a state entity that used the contract modality for the provision of services, if not all of them, the adjudicator has to do the analysis of whether or not there was an employment relationship without solution of continuity to determine the interregnum in which the entity must be sentenced to pay the social benefits that have not prescribed.
