The present article of review is orientated to study the sexual identity as components of the resocialization as principal assignment of a sorrow in the Social and Democratic State of Law. This from a qualitative approach of the major categories that converge in the process of rehabilitation of persons belonging to sexual minorities, used as a method description. Finding the model of social and democratic state of law determines the purpose of punishment, which boils down to the resocialization and rehabilitation of offenders given the project of life of the convict and his unique vision of the world, provided they do not violate principles social values. Respect for sexual orientation and gender identity is a component of the process of rehabilitation which demand of the authorities design plans or strategies that encourage respect for constitutional guarantees.
