Abstract

SEJEAN, Michel. Challenges of promoting French Civil Law in English. Rev. Derecho Privado [online]. 2014, n.27, pp.17-31. ISSN 0123-4366.

As a result of globalization, continental legal systems must reassess their influence. It is obvious that legal systems based on common law have successfully spread out, but its hould not bar French jurists from wondering whether the English language could improve the promotion of French civil law. However, this is a very sensitive issue: there is a strong relation between "la francophonie" and the promotion of the French Civil Code, and not until recently, French scholars have started to accept that the English language could be compatible with the promotion of French civil law. Two challenges must be met: the first one is to spread French civil law in English; and the second one is to command the English vocabulary of civil law. These are the two challenges which are presented in this paper.

Keywords : French Law in English; French Civil Code; Civil Code; Legal English; Legal Translation; Draft common Frame of Reference; "Doing Business"; French Law of Obligations; Louisiana Civil Law.
