Abstract
OPAZO GONZALEZ, MARIO ALEJANDRO. Good Faith as A New Argument to Sustain the Proceeding of a Compensation Action Among the Family Members. Rev. Derecho Privado [online]. 2020, n.39, pp.61-83. Epub Oct 31, 2020. ISSN 0123-4366. https://doi.org/10.18601/01234366.n39.04.
The present work aims to prove that good faith might be considered not only as a principle within the patrimonial Civil Law, but also as a principle within the Family Law. Being like that, family good faith would allow to determine that the members of a family have the duty of behaving loyally and correctly while accomplishing the duties and obligation among them, so a disloyal and incorrect behavior would constitute bad faith, which can be considered as an argument to sustain a compensation action for the breach of family duties.
Keywords : good faith; family good faith; compensation; Chilean law.
