The present paper discusses the position of pre-and post-marital agreements in the Chilean legal system, with the view of conclude if, taking in account the social and legal changes of the past decades, the public order objections, that they have traditionally faced have been removed or, at least, weakened, in a scope, that allow them to be currently validly celebrated.
