Abstract

From the constitutional need to integrate the concept of progressive autonomy of the minor in the internal regulations, the authors propose the plausibility, for the Chilean case, of understanding the aforementioned principle compatible with the system of protection based on disability and invalidation, provided that each one is assigned a separate field of application: the first for extra-economic acts and interests, the second for property businesses. This interpretative proposal allows the preservation of the advantages of the private law's incapacitation/invalidation system applicable to the acts carried out by a relatively incapable minor-adult, on one hand, with the necessary recognition of the decisions of the progressively autonomous adolescent in the personal sphere, on the other.
