The purpose of this article is to offer an interpretation of D. 2.14.17 pr. (Paul. 3 ad ed.), a fragment in which the Roman jurist Paulus explains the structure of the re contrahere from the perspective of its actionability through the condictio, implicitly identifying it with the mutui datio, the paradigm of credere in classical Roman law. In this sense, the fragment represents an argument for the idea that classical jurisprudence limited the obligatio re contracta, basis of the modern concept of real contract, to the consumer loan, excluding the gratuitous loan, the deposit and the pledge.
