Abstract

VELASQUEZ POSADA, Héctor. The social work of legal consultation centers: a necessity or an obstacle?. Rev. Fac. Derecho Cienc. Polit. - Univ. Pontif. Bolivar. [online]. 2012, vol.42, n.116, pp.51-76. ISSN 0120-3886.

This is a dogmatic-critical study aimed to demonstrate that the social function of the legal consultation centers is one of the most onerous burdens undergone by law professors whose students are participating in the practices that are established in Decree 196 of the year 1971 and the Law 583 of the year 2000. This legal framework clearly establishes the obligations for the students when they act on their own behalf, but it does not do so for the legal consultation center as a whole. In the context of the 1991 Constitution, such burdens violate the right to equality of law students, as well as to University autonomy and its own academic freedom. In addition, the implementation of the legal framework is a major pedagogical obstacle because it is biased towards some of its contents and prevents the realization of some practical activities necessary for the proper formation of the lawyer required by today's society.

Keywords : legal consultation centers; competition; university autonomy; social burden; right to equality; lawyer of the poor.
