The author of this essay seeks to identify in the proportionality test a control mechanism on legislative interventions of the right to evidence. For this purpose the concept of right to evidence is exposed and then the proportionality test is discussed, emphasizing its benefits avoiding unreasonable restrictions on the right to evidence in the judicial processes.
