Abstract

This research article has a goal to analyze the coexistence between the collective bargaining - agreement between the union and the employer - and the collective agreement - agreement between non-unionized workers and the employer - within a company as a reality that does not recognize the 87, 98 nor the 154 International Labour Organization and Committee on Freedom of Association agreements. By using legal sociology both the labor law and its application are approached from a documentary analysis methodology from Colombian labor reality as an academic input with regard to the protection and warranty of the freedom of association. The purpose is to conclude that this coexistence is a jurisprudence’s outcome contrario sensu to international agreements of freedom of association.
