This work aims to analyze the possibility of the prescription of assets belonging to public enterprises as a consequence of the effectiveness of the constitutional imperative of the social function of property. The deductive method was used, starting from the effectiveness of fundamental rights. The right to property and the institute of prescription will be examined, including their concepts, limits, and relevance to the social context. Additionally, the functions and purposes of public enterprises will be explored, and in the end, the possibility of prescription based on the activity carried out by the public enterprise will be sought, ensuring compliance with the inalienability of public assets as provided by the Federal Constitution.
