In this essay will be sustained that Colombia is whiting the tenets of the neo-constitutionalist paradigm. For develop argumentation is used the framework drawn by Miguel Carbonell in whereby a new Constitution, some renewed case-law practices and theoretical developments, allow determine the degree of influence of the neo-constitutional in a legal system. It explain these aspects and its emphasized in the role of the judge from the Constitutionalization of law, dismissing two of the most Recurring criticism towards the "new Law" in Colombia.
