Abstract

PLATA LOPEZ, Luis Carlos  and  YEPES CEBALLOS, Donna. NATURALEZA JURÍDICA DE LAS NORMAS COMUNITARIAS ANDINAS. Rev. Derecho [online]. 2009, n.31, pp.196-223. ISSN 0121-8697.

The community law by virtue of its supranationality is constituted in a special classification different from the national and international laws that is inserted in the juridical national classifications with a superior value to the national law which it displeases or substitutes in a direct and automatic form. There is an ordered system of laws where the first one is the "Community Constitution" and then derivatives or secondary that come from the community organs. Also is recognized the importance of this procedure in the conformation of the block of constitutionality. The Andean law escapes from the normal controls of legality and for its fulfilled execution each country preserves residual or complementary competitions of legislative nature. The Andean Court of Justice is the authority in the Andean law and its activity adds to that of the State Judge in the same sense.

Keywords : Supranationality; Community Constitution; derivatives or secondary laws; prejudicial interpretation.
