Abstract

The aim of this study is to deepen into one of the key elements for the existence of civil liability in copyright, which is the event of a conduct which appropriates or violates any of the areas protected by copyright, analyzing first whether it is required to configure it. It will also determine the existence of the subjective element (fault or intention), or if on the contrary, if it is possible to predicate the existence of a system of strict liability in the issue of copyright concerns, also it will be possible to set behavioral requirements to be causing that lead to the duty to indemnify.
