Abstract

The intensity threshold in serious situations of human rights violations is a fundamental criterion for the material application of International Human Rights Law and International Law of Human Rights since in contemporary armed conflicts the hostility dynamics due to the modus operandi of the new actors implies a serious of changes that impede or difficult the legal adequacy in International Public Law. Therefore, it comes to jurisprudence and doctrine to elucidate objective criterion that aid in the determination of the most adequate legal adequacy to face them according to the use of force in Human Rights or International Human Rights situations.
