Abstract

BUSTAMANTE, CARLOS JULIO GIRALDO. The Code Napoleon and the contract: birth and development of a theory. Rev. Derecho [online]. 2019, n.51, pp.111-132.  Epub Mar 14, 2020. ISSN 0121-8697.  https://doi.org/10.14482/dere.51.346.

Napoleon's Civil Code has strongly influenced the codifications that were made after him, and in a very special way in the Chilean civil code and, therefore, in ours. This article deals with the philosophical and political foundation of this code, centered on the concept of contract with the purpose of explaining what the legislators wanted to do with this notion, fundamental for the law in general, and the consequences that it had.

Keywords : Code; contract; economic and political liberalism; autonomy of the will; freedom.
