The objective of this article is to establish whether the concept of strategic litigation is not defined in the internal legislation of Colombia, but is developed by the different administrative or judicial entities with the exercise of the actions that are already provided for in the law, whether ordinary or constitutional, nature, as in the case that we will then study class actions for the protection of collective rights to the environment, public health and others that are closely related to environmental law, where we can demonstrate that with the exercise of these actions has been able to achieve a change in public policies, even if the outcome of the litigation has not been positive for the Claimants.
