Abstract
VALBUENA LATORRE, PAOLA FERNANDA and BADILLO SARMIENTO, REYNELL. Biofuels and Human Rights to Water and Food in Colombia: the Implementation of the UN Guiding Principies on Business and Human Rights. Rev. Derecho [online]. 2020, n.54, pp.178-200. Epub June 22, 2021. ISSN 0121-8697. https://doi.org/10.14482/dere.54.323.4.
This article returns to the discussion on the international responsibilities of private companies based on the case of biofuel producers in relation to the rights to water and food. To this end, it analyzes the level of compliance of the UN Guiding Principles on Business and Human Rights of the 13 largest biofuel producers in Colombia. We conclude, on the one hand, that although there is evidence to consider that biofuel production negatively impacts access to water and food, most companies in Colombia have not established mitigation plans or ways to remedy these damages. On the other hand, it is the larger companies that have established political commitments and fulfilled their duty of due diligence, which seems to indicate that access to more resources produces higher levels of compliance. This suggests that the voluntary approach to international human rights regulation is the most important approach for companies.
