Abstract

GAUCHE-MARCHETTI, XIMENA et al. Judging from a Gender Perspective. Theory and Regulations of a Strategy to Face the Challenge of the Effective Legal Protection of Rights for Women and LGBTIQ+ People. Rev. Derecho Estado [online]. 2022, n.52, pp.247-278.  Epub Jan 24, 2023. ISSN 0122-9893.  https://doi.org/10.18601/01229893.n52.08.

This work aims to defend the inclusion of the gender perspective as a tool that favors the legal protection of rights for women and LGBTIQ+ people. We uphold the idea that the access to justice must be understood as an essential human right in a democratic state. So, it is relevant to remove obstacles affecting these categories of people in line with the international human rights standards. In this context, based on the Chilean case, we endorse the idea that, within the jurisdictional function, the gender perspective contributes to a more effective protection of rights.

Keywords : Access to justice; legal protection of rights; women; LGBTIQ+; discrimination.
