Abstract

ESPEJO YAKSIC, NICOLÁS  and  LATHROP, FABIOLA. Towards the Constitutionalization of Family Law in Latin America. Rev. Derecho Privado [online]. 2020, n.38, pp.89-116. ISSN 0123-4366.  https://doi.org/10.18601/01234366.n38.04.

This paper seeks to address several key rulings handed down by Latin American courts on issues with a direct impact on family law: sexual orientation, gender identity and filiation. In doing so, we attempt to highlight the emergence of an embryonic process that could be labelled as the "constitutionalization of family relations" or the progressive adjudication of constitutional rights in the field of family law.

Keywords : Constitutionalization; Child Law; Sexual Orientation; Gender Identity; Filiation.
