This paper analyzes the compensation action of an insurance company, for damages to the carrier in the event that the cargo is lost due to an armed robbery. Mainly, two questions will be reviewed: (1) how does the unforeseeable or force majeure exception that the carrier opposes to the insurance company demand operate?; and (2) the origin of an autonomous compensation for damages. For the above, the Chilean doctrine and jurisprudence and comparative will be used on the points to be reviewed.
