Abstract
ARISTIZABAL GOMEZ, Kelly Viviana. What are we talking about when we refer to disability? A theoretical and legal revision of the concept. Civilizar [online]. 2021, vol.21, n.40, pp.59-72. Epub Apr 25, 2022. ISSN 1657-8953. https://doi.org/10.22518/jour.ccsh/2021.1a05.
This paper, which derived from the research project “Labor inclusion and disability: a theoretical review and a characterization. The objective of the cases of Santa Marta, Barranquilla and Cartagena,” examines the concept of disability from the models that explain this condition and the legal regulations within the framework of labor inclusion. The results, scrutinized from a descriptive method, show the reflections and challenges of labor law when facing the different scopes attributed to this concept over time. The conclusions highlight the importance of rethinking the concept of disability in the face of labor inclusion and starting from the social model focused on rights, where a disability is understood as a condition experienced by individuals with different characteristics as a result of their interaction with obstacles that prevent them from accessing work or working under equal opportunities with respect to other people.
