Abstract

This artícle presents an overview of the current situation of households affected by separation or divorce and discusses the mechanisms applied by the judicial system in these circumstances. These mechanisms are considered ineffective in that they do not preserve the family relationships necessary for the development of all family members. It also addresses mechanisms for the renewal and improvement of the judicial system by using, among other things, alternative complementary approaches to conflict resolution, such as judicial or intra-judicial mediation. Lastly, it examines an initiative launched by the General Council of the judicial Power in 2006 for implementing and developing intra-judicial mediation services at different locations in Spain from the perspective of the professionals involved.
