Abstract

RODRIGUEZ GONZALEZ, Víctor; CASTRO TOLEDO, Francisco Javier; GARDA-GARDA, David  and  VELANDIA PARDO, Elmers Freddy. Jurisprudence on psychophysiological methods in judicial statements as a nexus of psycho-criminological knowledge. Rev. Cient. Gen. José María Córdova [online]. 2021, vol.19, n.36, pp.1065-1080.  Epub Oct 01, 2021. ISSN 1900-6586.  https://doi.org/10.21830/19006586.779.

This article analyzes the existing jurisprudence in Spain regarding the validity of different procedures known as lie detectors and their acceptance in judicial proceedings. It addresses the psychology of testimony as a background that assesses the credibility of the declarants, not their statements’ veracity. It establishes that this evidence, mainly requested by the accused to prove innocence based on the testimony’s credibility, is devoid of any other types of evidence. The analysis rejects using these tools in judicial processes, based on the lack of greater experimentation to obtain accurate statements and a lack of knowledge of these processes, concluding that other types of valid evidence must always bolster these methods.

Keywords : court judgment; criminal law; expert evidence; jurisprudence; polygraph; testimony.
