Abstract

The present text aims to reflect on what has been the effect of neoliberalism on education and how the dynamic of the juridification of conflicts in schools has either slowed down or contributed to this effect. To do so, a theoretical research with a hermeneutic approach was proposed as a method of investigation. Based on the categories of analysis proposed, the specific case of schools in Colombia was investigated, as well as the way in which constitutional jurisprudence is embedded in this dynamic. The results show that there are transformations in the school as a result of neoliberalism, such as the privatization of education, the development of skills and entrepreneurship. At the same time, there are mechanisms to counterbalance the economic rationality resulting from the tensions generated by these demands, especially those that are translated into school manuals and rules of conduct that have led to the intervention of judges. The article concludes that in spite of criticisms of constitutional jurisprudence in the school environment, these decisions have vindicated the democratic ends and training for the autonomy that education should pursue.
