Abstract

CHAPARRO PACHECO, Ricardo. Law, Justice, and Transition: A Psychoanalytic Approach to Transitional Justice and Recent Experience in Colombia. Trab. soc. [online]. 2016, n.18, pp.45-55. ISSN 2256-5493.

The granting of amnesties to facilitate peace and the individual application of punishment to encourage justice produce a tension underlying transitional justice. This tension provides an opportunity to explore the relationship between law, subject and justice from a psychoanalytic perspective. Focusing on the desire and jouissance that inhabit the subject leads to the conclusion that transitional justice should center more on how to judge than on how to punish. Such a scenario opens to Social Work a line of inquiry about the relationship between law and social change.
