Technology offers the possibility of exploring new scales and inaugurates a new way of understanding nature with nanotechnology, an applied science that has been developed through a sophisticated techno-scientific apparatus; reflection on its infinite range and its risks are driven by the certainty of the uncertainty of the scientific models that create this new reality. In this area, the law is forced to confront complex and interdisciplinary problems, often based on a scientism that confers credibility only on what it produces and that, due to the speed with which news is transmuted, remains out of sync with the pace of legal dogmatics. Therefore, this study uses the inductive method of research, employs, in essence, bibliographic research, and aims to reflect on the challenges posed by legal science to indicate the need to strengthen the appropriate decision parameters that lead to the best possible way to address the nuances and challenges imposed by nanotechnology.
