This article presents the research results whose main objective is to determine whether the extension of the Unification jurisprudence issued by the Council of State, a figure created by Law 1437 of 2011 concerning state liability for unjust deprivation of liberty, has been effective as a mechanism of judicial decongestion. The work yields some sensitive data, among which is the little application given to this mechanism of extension of jurisprudence in this type of liability and the null viability that the Attorney General’s Office and the Judicial Branch in Colombia are providing to these requests.
