Abstract

The crime of stalking was recently typified in the Brazilian legal system, and the importance of the thematic examination translates into the countless daily situations of persecution, notably concerning women, to threaten the physical and psychological integrity of the victims, restrict their ability to move about or invade their sphere of freedom and privacy. The research examines the characteristics of the crime, making a historical and comparative law approach. Finally, it makes a critical analysis of the insufficiency of criminal law, concluding that the entire issue involves a multifactorial perspective, going through the execution of efficient public policies, not reducing the number of cases only by simple criminal protection.
