Abstract

The analysis of the effective judicial protection of human rights can be carried out from different perspectives: constitutional law, procedural law, to name a few. The hermeneutic method was applied for the review of judgements on the subject. It is pointed out that an adaptation of the Venezuelan legal system must be proposed to ensure the effectiveness of such that are implicitly recognized, regardless of whether they are exhaustively enunciated in national regulations. It is then up to the judges to be guarantors of compliance with the protection of human rights.
