This article deals with the discussion that has taken place around humanism in contemporary penal thought. We try to answer those who critique penal systemic functionalism by analyzing the philosophical and scientific context that is the pillar of this debate. Thus, we show how luhmannian negative humanism lifts some epistemological obstacles present in the arguments against penal functionalism.
