One of these powers granted by the legal system to the State as a subject of law is the ius puniendi, which is the right that empowers the state to punish or punish the administration that incurs a breach of the provisions of the legal system, using of his faculty of Imperium and managing to guarantee through his control an adequate social coexistence.
The purpose of this research is to establish a critique of the responsibility established in the Peruvian system, applying an analytical methodology.
The sanctioning administrative procedure starts from the conception that the State is an entity in which a considerable number of powers converge, that when exercised as indicated by the legal norm, will generate in all the administered an erga omnes effect.
