Abstract

ARBOLEDA RAMIREZ, Paulo Bernardo  and  ARISTIZABAL, José Fredy. Balancing the principle of privacy and the principle of freedom of information: applying the objective measuring method. Rev. Fac. Derecho Cienc. Polit. - Univ. Pontif. Bolivar. [online]. 2019, vol.49, n.130, pp.28-50.  Epub Sep 15, 2019. ISSN 0120-3886.  https://doi.org/10.18566/rfdcp.v49n130.a02.

The present paper carries out a case-law tracking which accounts for the debates held in the Corte Constitucional regarding the balancing of the principle of privacy and the principle of freedom of information. The study is based on the guidelines outlined in the most relevant court decisions about balancing, such as C-673 de 2001 and C-093 de 2001. Finally, based on a hypothetical case, the balancing of these principles is performed by employing an objective measurement proposed by Carlos Bernal Pulido.

Keywords : Fundamental rights; Neo-constitutionalism; Balancing, Law principles.
