Abstract

GONZALEZ SERRANO, Andrés. TIMELY SUBMITTION OF A PETITION BEFORE THE INTER-AMERICAN COMMISION ON HUMAN RIGHTS. Prolegómenos [online]. 2014, vol.17, n.33, pp.57-76. ISSN 0121-182X.  https://doi.org/10.18359/dere.783.

The article addresses and analyzes the conventional and statutory limit of six months that must be taken into account when submitting a petition before the Inter-American Commission on Human Rights. Through the development of a basic, descriptive and deductive research, it obtains an analysis result that addresses the following question: how the six-month period that the victims have to submit a petition to the Inter-American Commission should be understood? The general objective is to identify the argumentation lines of the Commission when a State proposes the inadmissibility of the petition because of untimely submission.

Keywords : Inter-American Commission; admissibility; timely submission; exhaustion of domestic remedies; reasonable period.
