This article aims at establishing an analysis from the history of Law on the so-called apocryphal order which in May of 1810 liberalized the commerce in the Indies. This case is a significant example of the Law-creation processes in the Hispanic world during the crisis of the old regime. Upon examining the cause pursued against the authors of that order, the article exposes two kinds of normative production that are respectively expressive of two conceptions -the old one and the contemporaneous one- over the administration of power in the Hispanic constitutionalism at the beginning of the 21st century.
