Abstract

QUINTERO, Fabián A.. Penitentiary treatment in Buenos Aires Province: The challenge for adjusting legislation to international practice. Opin. jurid. [online]. 2011, vol.10, n.19, pp.171-178. ISSN 1692-2530.

The penitentiary treatment in the province of Buenos Aires (Argentina), is regulated by the law 12.256 in generic form. This norm does not make any difference among the general conditions to guarantee the feasibility of the penitentiary treatment and the objectives and reaches of the treatment itself. Differentiating the three aspects of the penitentiary function that is, the penitentiary treatment, the penitentiary attendance, and the preservation of rights of people in jail, the purpose here is to analyze the current instruments which establishes the legislation and consequently to pose possible adjustments to international norms. The necessity for modifications which allow defining the intervention object, to delineate the objectives and their reaches, to determine the base conditions of the intervention and to guarantee long term evaluations, correcting in this way the structural myopia of the penitentiary institutional program, is deduced from a compared analysis.
